Daily Sunrise Investigations Desk
A reader has contacted the Daily Sunrise Investigations Desk alleging procedural irregularities during a recent county court hearing. Documents and correspondence provided to this publication are currently being reviewed.

According to documents reviewed by this publication suggest that judgment was delivered following reliance upon a witness statement submitted by the claimant’s solicitor, despite the litigant contending that key factual assertions within the statement could have been independently verified through Employment Tribunal records.
Sources familiar with the proceedings further allege that the litigant’s evidential bundle was not before the judge at the commencement of the hearing, raising questions as to whether all relevant material was fully considered before judgment was reached.
Legal commentators consulted by Daily Sunrise note that the circumstances described may raise questions regarding several important procedural safeguards within the Civil Procedure Rules, including:
- CPR Part 1 – the overriding objective to deal with cases justly and proportionately.
- CPR Part 32 – the proper consideration and scrutiny of witness evidence.
- CPR 3.1 – the court’s case management responsibilities.
- CPR 40.2 – the requirement to provide reasons for judicial decisions.
Observers have also highlighted the relevance of the Equal Treatment Bench Book, which emphasises the judiciary’s responsibility to ensure that litigants-in-person are not placed at a disadvantage because they lack legal representation.
Court records indicate that an earlier hearing had been adjourned following issues relating to disclosure. However, concerns have been raised that the subsequent hearing focused primarily on substantive issues without first addressing the disclosure concerns that had led to the earlier adjournment.
The litigant’s counterclaim was ultimately dismissed. Questions have since been raised regarding the extent of the reasons provided and whether all evidential issues were fully addressed during the proceedings.
Separate allegations have also been made concerning the conduct of the claimant’s solicitor. While no regulatory findings have been made, legal professionals contacted by Daily Sunrise note that the allegations, if proven, could potentially engage provisions of the Solicitors Regulation Authority Code of Conduct, including:
- Principle 2 – acting with integrity.
- Rule 1.4 – avoiding unfair advantage over third parties.
- Rule 7.1 – the obligation not to mislead the court.
The matter highlights wider questions being asked across the legal profession concerning access to justice, procedural fairness, and the challenges faced by litigants who appear in court without legal representation.
The Daily Sunrise Investigations Desk is continuing to review relevant documents and correspondence. Legal practitioners, court professionals, regulators, and members of the public with relevant information are invited to contact our Investigations Desk.
As the review continues, the case is likely to attract interest from those concerned with judicial accountability, professional conduct, and the practical operation of the civil justice system.
Daily Sunrise will publish further updates should additional evidence or responses become available.
